Property offences involve dishonestly taking or interfering with another person's property without their consent. These offences range from shoplifting to burglary and robbery. Minor offences are dealt with in the Magistrates Court and serious cases are heard in the Supreme Court.

There are a range of potential defences for property offences. Whether or not a defence will be successful depends on the circumstances of the case. Getting expert legal advice about a potential defence is important to do at an early stage after being charged.

What penalties apply for property offences?

Property offences is such a broad category of offending and it ranges from relatively minor offences like shoplifting through to robbery or arson. As with other categories, a person's personal circumstances and the facts of the case vary considerably and have an impact on the appropriate sentence.

A person who steals food because they are homeless and hungry who has never committed any other offence might receive a period of good behaviour. On the other hand, setting fire to a house or robbing someone at knife point will almost always lead to an actual term of imprisonment. Terms of imprisonment are common for property offences heard in the Supreme Court and it is important to get advice at an early stage from a criminal lawyer.
